Coolbus Mobile Application and Website Privacy Policy

This Privacy Policy (the “Policy”) compliments our Terms of Use and our COVID Release. Together, these three (3) documents represent the conditions of your use or your child's use of the Services, whether you access the Services through the website (www.coolbus.com) (the “Website”), the Coolbus mobile app for iOS or the Coolbus mobile app for Android (together the “App”). The Services include any functionality, content or assistance offered on or through the App or the Website. By accessing the Website, downloading or accessing the App, using the Services, or clicking to “Accept” or “Agree” when that option is made available to you, you accept and agree to abide by all terms specified in this document, our Terms of Use and COVID Release. If you do not want to agree to this Policy, our Terms of Use, and our COVID Release, you must not access or use the Services. Your agreement remains in full force and effect while you use the Services, unless terminated earlier in accordance with this Policy, our Terms of Use, and our COVID Release

Coolbus LLC (“Coolbus” or “We”) respects your privacy and is committed to protecting it through our compliance with this privacy policy (the “Policy”). This Policy describes:

  • The types of information we may collect or that you may provide when you purchase, download, visit, install, register with, access, or use the Coolbus Mobile Application (the “App”) or our Website, www.coolbus.com (the “Website”) (collectively the “Services”). 

  • Our practices for collecting, using, maintaining, protecting, and disclosing that information.

At this time, Coolbus does not offer Services to users in California or Nevada, nor to anyone outside of the United States.  If you are not a resident of the United States or if you are a resident of California or Nevada, do not use our Services, or access the Website or the App. If you are a resident of California or Nevada or are a non-US resident and have already downloaded the App, please delete it from all of your devices and do not use it.

This Policy applies only to information we collect:

​

  • Through the Services.

  • In email, text, and other electronic communications sent through or in connection with the Services. 

  • When you interact with our advertising and applications on third-party websites and services, if those applications or advertising include links to this Policy.

This Policy DOES NOT apply to information collected by:

​

  • Coolbus offline or through any other means.

  • Any third party (including our affiliates and subsidiaries) collecting information for itself through any application or content (including advertising) that may link to or be accessible from the Services.

 

These other third parties may have their own privacy policies, which we encourage you to read before providing information on or through them.

Please read this Policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, do not download, register with, access, or use the Services. By downloading, registering with, accessing, or using the Services, you agree to this Policy. This Policy may change from time to time (see <<Changes to Our Policy>>). Your continued use of the Services after we revise this Policy means you accept those changes, so please check the Policy periodically for updates.


Children Under the Age of 18

The Services are not available for children under 13. While the Services are available to users beginning at 13 years of age, for any users who are 13 to 18 years of age (or the age of majority in the applicable jurisdiction) (each a “Teen User”), Coolbus must receive parental/guardian consent (“Guardian Consent”) before a Teen User’s Coolbus account will be unlocked to use the Services.  If you are providing Guardian Consent for a Teen User, you represent and warrant that (1) you are the parent/guardian of the Teen User, (2) you have reviewed and agree to these Terms, (3) you agree to monitor the account of the Teen User and that user’s activities relative to the Services, and (4) you authorize the Teen User to become a registered user of the Services and grant permission for the display of any personal information or images that the Teen User posts to his or her public Coolbus profile. If you believe we might have any information from or about a child under 13, please contact us at privacy@coolbus.com.

Information We Collect and How We Collect It

​

We collect information from and about users of our Services:

​

  • Directly from you when you provide it to us, such as by filling in forms provided through the Services, including, but not limited to, information you provide when registering for the Services, posting material to the Services, requesting further Services, completing surveys, or sending emails or making telephone calls to us for any reason, including reporting a problem with the Services.

  • Automatically when you use or navigate through the Services. Information collected automatically may include usage details, IP addresses, and information through cookies, web beacons, and other tracking technologies. 

  • From third parties, including but not limited to, other users, our business partners, contractors, and other third parties (including schools and school districts). 

 

Information You Provide to Us

When you download, register with, access, or use the Services, we may ask you to provide some or all of the following information:

  • "Personal Information": is information by which you may be personally identified or by which you may be contacted online or in real life, and may include your name, user name, postal address, email address, telephone number, specific location information, and other information. Personal Information may also include information by which your family members, or others on whose behalf you are using the Services, may be identified, including their names, postal addresses, email addresses, telephone numbers, and specific location information.

  • "Non-Personal Information": is information about you or anyone on whose behalf you use the Services, but this information individually does not identify you or allow others to contact you and may include pick-up and drop-off information, purchase history, your interests and activities, general location information (such as school and school district), general characteristics such as grade in school, and other non-identifying demographic or profile information.  Non-personal Information may also include information about your Internet connection, the equipment you use to access the Services, and information about your patterns of use for the Services.

Automatic Information Collection and Tracking

When you download, access, navigate through, interact with, and use the Services, we may use technology to automatically collect:

​

  • Usage Details. Certain details of your access to and use of the Services, including traffic data, location data, logs, and other communication data and the resources that you access and use on or through the Services.

  • Device Information. Information about your mobile device, computer, and internet connection, including unique device identifier, IP address, operating system, browser type, mobile network information, and telephone number.

  • Stored Information and Files. Metadata and other information associated with other files stored on your mobile device or computer. This may include, for example, photographs, audio and video clips, personal contacts, and address book information.

  • Location Information. Real-time information about the location of your device. 

 

If you do not want us to collect this information do not download the App or use our Services. If you have already downloaded the App, you may delete the App from your device.

Information Collection and Tracking Technologies 

​

The technologies we use for automatic information collection may include:

​

  • Cookies (or browser / mobile cookies). A cookie is a small file placed on your smartphone or the hard drive of your computer. It may be possible to refuse to accept cookies by activating the appropriate setting on your smartphone or browser. However, if you select this setting you may be unable to access certain parts of the Services. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to our Website or use our App. 

  • Flash Cookies. Certain features of the Services may use local stored objects (or Flash cookies) to collect and store information about your preferences and navigation to, from, and on our Website, in particular. Flash cookies are not managed by the same browser settings as are used for browser cookies. 

  • Web Beacons. Pages of the App, our Website, and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit Coolbus, for example, to count users who have visited those pages or opened an email and for other related app statistics (for example, recording the popularity of certain app content and verifying system and server integrity).

  • Log Data. When you use the Services, in case of an error in the App, we collect data and information (through third-party products) on your mobile device called Log Data. This Log Data may include information such as your device Internet Protocol (“IP”) address, device name, operating system version, the configuration of the App when utilizing our Services, the time and date of your use of the Services, and other statistics. 

 

Third-Party Information Collection

 

When you use the Services, certain third parties may use automatic information collection technologies to collect information about you or your device. These third parties may include:

  • Advertisers, ad networks, and ad servers;

  • Content providers;

  • Application providers;

  • Analytics companies;

  • Your mobile device manufacturer; and

  • Your mobile service provider.

 

These third parties may use tracking technologies to collect information about you when you use the Services. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites, apps, and other online services websites. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.
 
We do not control these third parties’ tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.

How We Use Your Information

We use information that we collect about you or that you provide to us, including any personal information, to:

  • Provide you with the Services and their contents, and any other information, products or services that you request from us.

  • Fulfill any other purpose for which you provide it.

  • Give you notices about your account, including expiration and renewal notices.

  • Carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.

  • Notify you when App updates are available, and of changes to any products or services we offer or provide though our Services.

  • To allow you to participate in interactive features offered on our Services

  • In any other way we may describe when you provide the information. 

  • For any other purpose as permitted by law or with your consent.

We use the usage information we collect to help us improve our Services and deliver a better and more personalized experience for you by:

  • Estimating how many users we have and their usage patterns.

  • Storing information about your preferences, allowing us to customize our Services according to your individual interests.

  • Speeding up your searches.

  • Recognizing you when you use the Services.


We use location information we collect to connect you with other App users in your community to allow you to arrange for and schedule Services with other users of the Services.

We may also use your information to contact you about our own and third parties’ goods and services that may be of interest to you. If you do not want us to use your information in this way, adjust your user preferences in your account profile or email us at privacy@coolbus.com.

We may use the information we collect to display advertisements to our advertisers’ target audiences. Even though we do not disclose your personal information for these purposes without your consent, if you click on or otherwise interact with an advertisement, the advertiser may assume that you meet its target criteria.

Disclosure of Your Information

We reserve the right to disclose aggregated information about our users, and other information that does not identify any individual or device, without restriction.

In addition, we may disclose personal information that we collect or you provide:

  • To our subsidiaries and affiliates.

  • To other users who are connected to the Services or who are in your phone contacts that you imported into the service. These users may be able to view limited personal information about you. 

  • To contractors, service providers, and other third parties we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them.

  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Coolbus’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Coolbus about users of our Services is among the assets transferred.

  • To third parties to market their products or services to you if you have not opted out of these disclosures. We contractually require these third parties to keep personal information confidential and use it only for the purposes for which we disclose it to them. 

  • To fulfill the purpose for which you provide it. For example, if you give us an email address to use the "email a friend" feature of our Services, we will transmit the contents of that email and your email address to the recipients.

  • For any other purpose disclosed by us when you provide the information.

  • With your consent.

We may also disclose your personal information:

​

  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.

  • To enforce our rights arising from any contracts entered into between you and us, including the App End User License Agreement or our <<Terms of Use>> and for billing and collection.

  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Coolbus, our customers or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

Your Choices About Our Collection, Use, and Disclosure of Your Information

​

We strive to provide you with choices regarding the personal information you provide to us. This section describes mechanisms we provide for you to control certain uses and disclosures of your information.
 

  • Tracking Technologies. You can set your browser to refuse all or some browser cookies and set your mobile device to refuse all mobile cookies, or to alert you when cookies are being sent. If you disable or refuse cookies or block the use of other tracking technologies, some parts of the Services may then be inaccessible or not function properly.

  • Location Information. You can choose whether or not to allow the App to collect and use real-time information about your device's location through the device's privacy settings. If you block the use of location information, some parts of the App may become inaccessible or not function properly.

  • Promotion by Coolbus. If you do not want us to use your contact information to promote our own or third parties' products or services, you can opt-out by emailing privacy@coolbus.com or, if feature is available, you can change your preferences in your account settings.  

  • Targeted Advertising by Coolbus. If you do not want us to use information that we collect or that you provide to us to deliver advertisements according to our advertisers' target-audience preferences, you can opt-out by sending us an email stating your request to privacy@coolbus.com or, if the feature is available, you can change your preferences in your account settings. 

  • Disclosure of Your Information for Third-Party Advertising and Marketing. If you do not want us to share your personal information with unaffiliated or non-agent third parties for advertising and marketing purposes, you can opt-out by sending us an email stating your request to privacy@coolbus.com or, if feature is available, you can change your preferences in your account settings.

We do not control third parties’ collection or use of your information to serve interest-based advertising. However these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI”) on the NAI's website.

Accessing and Correcting Your Personal Information

​

You can review and change your personal information by logging into your account and visiting your account profile page.

​

You may also send us an email at privacy@coolbus.com to request access to, correct, or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

 

Data Security

​

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. However, the safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Services, you are responsible for keeping this password confidential. You must not share your password with anyone or allow third parties to use your account.

Unfortunately, the transmission of information via the internet and mobile platforms is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted through our Services. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures we provide.

Changes to Our Policy

We may update our Policy from time to time. If we make material changes to how we treat our users' personal information, we will post the new Policy on this page and notify you by email to the email address specified in your account.

The date the Policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you and for periodically visiting this Policy to check for any changes.
